Welcome to KiraClubs (the "Platform"). These Terms of Service ("Terms" or "Agreement") govern your access to and use of the KiraClubs website, mobile applications, API services, and associated systems (collectively, the "Service"). By registering an account, downloading our mobile app, or using any feature, you represent and warrant that you have read, understood, and agreed to be bound by this Agreement.

1. ELIGIBILITY AND AGE RESTRICTION (STRICTLY 18+)
The Service is strictly intended for individuals who are at least eighteen (18) years of age or older. Any access, registration, or use of the Service by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms. By creating an account, you represent and warrant that you are of legal age (18+) and have the full capacity to enter into this legally binding agreement. We reserve the right to demand proof of age at any time and to terminate accounts immediately if we suspect a user is under the age of 18.

2. ACCOUNT REGISTRATION, SECURITY, AND VERIFICATION
2.1. Registration: To access features such as direct messaging, video calls, and voice rooms, you must register an account using a valid email address, phone number, or third-party OAuth provider (such as Google, Apple, or TikTok). You agree to provide accurate, current, and complete information.
2.2. Account Security: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach.
2.3. Selfie Verification: To ensure the safety of our community, prevent fraudulent activity, and comply with safety policies, users (especially those requesting withdrawals or broadcasting in public rooms) may be required to upload a real-time verification selfie. This photo is checked against your profile photos to verify your identity. Accounts with incorrect or deceptive profile representations may be suspended or deleted.

3. VIRTUAL COIN (JETON) WALLET AND FINANCIAL SYSTEM
3.1. Jeton Purchases: KiraClubs provides a virtual credit system. Users may purchase virtual coins ("Jetons") through licensed third-party payment gateways (e.g., PayTR) or manually via bank transfer/crypto deposit notifications. Jetons have no real-world monetary value, do not earn interest, and are used solely to access platform features, send virtual gifts to other users/broadcasters, or unlock premium features.
3.2. No-Refund Policy: All purchases of Jetons are final, non-refundable, and non-transferable. You acknowledge that Jetons cannot be redeemed for real cash or currency from the Platform unless you qualify under the withdrawal policy for content creators/broadcasters.
3.3. Broadcaster Earnings and Withdrawals: Verified users and broadcasters who receive virtual gifts from other users accumulate virtual earnings in their platform wallet. These earnings can be converted into real-world currency and withdrawn via approved methods (such as local bank transfer/IBAN or USDT TRC20 crypto transfer) subject to: (a) meeting the minimum withdrawal threshold, (b) successful completion of identity verification/selfie checks, and (c) anti-fraud and anti-money laundering (AML) audits.
3.4. AML and Transaction Review: In compliance with international anti-money laundering policies, KiraClubs reviews all transaction logs. We reserve the right to freeze wallet balances, withhold payouts, or terminate accounts if fraudulent deposits, chargebacks, or suspicious activities are detected.

4. USER GENERATED CONTENT (UGC) AND CODE OF CONDUCT
4.1. Ownership of Content: You retain ownership of any text, images, voice messages, or streams you post ("User Generated Content" or "UGC"). However, you grant KiraClubs a worldwide, royalty-free, perpetual, transferable license to host, display, reproduce, and distribute your UGC to operate and promote the Service.
4.2. Prohibited Content: You are strictly prohibited from posting, streaming, or transmitting content that:

• Is sexually explicit, pornographic, or depicts nudity or sexual solicitation.
• Promotes prostitution, escort services, or human trafficking.
• Contains hate speech, racial slurs, defamation, harassment, threats, or incites violence.
• Infringes on the intellectual property, copyright, or privacy rights of third parties.
• Promotes illegal drugs, weapons, or gambling activities.

4.3. Monitoring and Moderation: KiraClubs maintains a zero-tolerance policy towards abusive conduct and illegal content. We reserve the right, but do not have the obligation, to monitor communications, chat history, and audio streams. Room hosts and moderators have the authority to mute, demote, or kick participants. The Platform reserves the right to remove any content and permanently ban violating accounts without warning or refund of outstanding balances.

5. INTELLECTUAL PROPERTY RIGHTS
All rights, titles, and interests in the KiraClubs Service, including software, design, user interface, brand name, logo, and proprietary source code, are owned exclusively by KiraClubs. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use our mobile application and website for social purposes in accordance with these Terms.

6. LIMITATION OF LIABILITY AND WARRANTY DISCLAIMER
6.1. No Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, security, or accuracy of the Service.
6.2. Limitation of Liability: To the maximum extent permitted by applicable law, KiraClubs, its affiliates, directors, or employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to financial losses, loss of data, or interactions with other users.

7. SUSPENSION AND TERMINATION
We reserve the right to terminate, suspend, or restrict your access to your account and the Service at our sole discretion, without notice or liability, for any violation of these Terms, non-payment, fraud, or to protect the safety of the platform community.

8. DISPUTE RESOLUTION AND GOVERNING LAW
This Agreement and any dispute arising out of or related to it shall be governed by, construed, and enforced in accordance with the laws of the Republic of Turkey. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts and execution offices of Istanbul, Turkey.

KiraClubs ("we", "us", or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy describes how we collect, process, use, store, and share your personal data when you use the KiraClubs website, mobile applications, API endpoints, and other platform services (collectively, the "Service"). 2. CHILD SAFETY STANDARDS AND EXPLICIT CSAE/CSAM PROHIBITION
KiraClubs and its developer mustafa Hazar Bilgin are strictly committed to keeping Google Play a safe platform for everyone. We maintain a zero-tolerance policy towards child abuse. Under our Child Safety Standards:
- We explicitly prohibit any form of Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Creating, sharing, soliciting, or facilitating such content or behavior on the Platform is strictly forbidden.
- We provide and maintain an active in-app mechanism for users to submit feedback and report suspicious or harmful content directly. Any reported CSAM/CSAE content is immediately removed, violating accounts are permanently terminated, and incidents are reported to relevant child protection authorities (including NCMEC).
- We fully comply with all applicable child safety laws and regulations.

3. INFORMATION WE COLLECT
We collect and process the following categories of personal data to provide a secure and functional matchmaking and social system:
2.1. Information You Provide Voluntarily:

• Account Credentials: Email address, phone number, display name, age, birth date, gender, and passwords.
• Profile Information: Biography, profile photos, interests, and matching preferences.
• Selfie Verification Photos: If you request identity verification (blue tick badge) or submit withdrawal requests, we collect a real-time photo of your face (selfie) to match it against your uploaded profile photos. This ensures profile authenticity and prevents financial fraud.
• Financial Information: For manual deposits and payouts, we collect your bank account details (IBAN, account holder name) or cryptocurrency wallet addresses (e.g., USDT TRC20).
• Customer Support Data: Any communication or files you submit when contacting our support desk.

2.2. Information Collected via Third-Party Authentication (OAuth):
If you choose to register or log in using third-party services like Google, Apple, or TikTok, we collect your basic profile details from those providers, such as your third-party unique user identifier (UID), display name, nickname, email address (if provided), and profile picture URL. This data is used solely to authenticate your identity and populate your initial profile.
2.3. Information Collected Automatically:

• Usage Data: Pages visited, match interactions, active session times, call history logs, chat metadata, and voice room status.
• Technical Data: IP address, device type, operating system version, screen resolution, browser type, and app crash logs.
• Location Data: Your approximate location derived from your IP address, or precise location if you explicitly grant permission through your mobile device settings.

2.4. User Generated Content (UGC):
We process the messages, images, voice notes, and audio streams you send or broadcast on the Platform. Please note that text messages, voice room audio, and images shared in group environments are visible to other participants.

3. LEGAL BASIS AND PURPOSES OF PROCESSING
We process your data under the following legal bases:

• Performance of a Contract: To register your account, manage matches, enable live voice/video rooms, process virtual wallet transactions, deposits, and pay out broadcaster earnings.
• Consent: For processing sensitive items like selfie verification photos or using precise location services (which you can withdraw at any time).
• Legitimate Interests: To maintain platform security, prevent scam/fake profiles, investigate harassment, analyze app performance, and block bad actors.
• Compliance with Legal Obligations: To maintain tax, accounting, and anti-money laundering (AML) records.

4. DATA SHARING AND DISCLOSURES
We do not sell, rent, or trade your personal data. We only share data with trusted third-party service providers and partners under strict data processing agreements:
- Hosting and Databases: Amazon Web Services (AWS) hosts our servers and databases securely.
- Real-time Audio and Streaming: Agora RTC processes the audio/video streams in voice rooms.
- WebSockets and Events: Laravel Reverb/Pusher protocols handle live chat and UI state synchronization.
- Payment Processors: Licensed payment gateways (such as PayTR) process credit card transactions securely without sharing card details with us.
- Legal Authorities: We will disclose data to law enforcement, government bodies, or courts if required by a valid legal subpoena, warrant, or regulatory audit.

5. COOKIES AND TRACKING TECHNOLOGIES
We use cookies, web beacons, and mobile identifiers to recognize your browser, save your session state, keep you logged in, and analyze usage trends. You can disable cookies in your browser settings, though some platform features may cease to function correctly.

6. DATA RETENTION AND DELETION POLICY
We retain your personal data only as long as your account remains active or as necessary to fulfill the purposes outlined in this policy.
6.1. Account Deletion and Data Purge Instructions:
You can request the complete and permanent deletion of your account and associated personal data at any time. To do so:

1. Go to your Profile Settings inside the KiraClubs mobile application.
2. Select the 'Delete Account' option and confirm.
3. Alternatively, you can email our support team directly at support@kiraclubs.com requesting account deletion.

Upon receiving your request, your account will be disabled immediately. All profile details, uploaded photos, matching records, and chat history will be permanently deleted or anonymized from our active databases within thirty (30) days. However, financial transaction logs (payout histories, deposit notifications, bank statements) will be kept for up to ten (10) years in accordance with applicable tax and financial audit regulations.

7. USER RIGHTS
Depending on your location, you have the following rights regarding your personal data:

• Right to access the data we hold about you.
• Right to correct or update inaccurate data.
• Right to request the erasure of your data (subject to legal retention requirements).
• Right to restrict or object to the processing of your data.

3. TRANSFER OF PERSONAL DATA
To provide the Service, your data may be transferred to and stored on secure servers located outside your country of residence (such as AWS Frankfurt servers for European/Turkish users), or shared with trusted third parties (such as Agora RTC for audio/video calling, and licensed payment gateways). These transfers are executed under standard contractual clauses to ensure GDPR/KVKK compliance.

4. METHOD OF COLLECTING PERSONAL DATA
Your personal data is collected automatically when you download/use the app, register via OAuth (such as Google, Apple, or TikTok), upload profile images, complete verification selfies, or submit deposit/withdrawal forms.

5. YOUR LEGAL RIGHTS
Under KVKK Article 11 and GDPR, you have the right to:

• Learn whether your personal data is processed or not.
• Request information if your personal data has been processed.
• Learn the purpose of processing and whether they are used appropriately.
• Know the third parties to whom personal data is transferred domestically or abroad.
• Request correction of incomplete or incorrect data.
• Request deletion or destruction of personal data under the conditions laid down in KVKK/GDPR.
